Terms of Use

These Terms of Use govern your use of this website and any services provided by Kervon LTD ("Kervon", "we", "us"), a company registered in England and Wales at The McLaren Building, 46 The Priory Queensway, Birmingham, B4 7LR, United Kingdom. Using this website, or engaging us for work, means you accept these Terms. If you don't, please don't use our Services.

Kervon provides application development for mobile, desktop and cross-platform utility apps; App Store Optimisation and growth marketing, including paid user acquisition and creative testing; and AI and automation feature development for apps we build or maintain. The exact scope, deliverables, timeline and fees for a specific engagement are set out in a written quote or statement of work, which takes precedence over these Terms if the two disagree.

Any quote you see on this site or receive by email is an estimate until we've confirmed it in writing. A project is considered live once both sides have agreed the scope and, where applicable, we've received an initial deposit.

Delivering work on time depends on us getting timely feedback, the assets and access we need — developer accounts, brand materials, existing analytics — and accurate information about your product and goals. If any of that runs late, the timeline may need to move with it.

Development projects are billed against agreed milestones. Growth, ASO and AI retainers are billed monthly, in advance. Any paid advertising spend within a retainer is passed through at cost and billed separately from our management fee. Invoices are due within 14 days unless we've agreed otherwise in writing; work may be paused if payment runs significantly late.

Once an invoice for a piece of work is paid in full, ownership of the custom code, designs and creative assets made specifically for you transfers to you, unless we've agreed something different in writing. Kervon keeps ownership of any tools, frameworks or components we built before your project and reuse across our work, and grants you a licence to use them as part of what we deliver.

Much of what we do depends on platforms we don't control — app stores, ad networks, operating system providers. We're not responsible for changes those platforms make to their own rules, algorithms or fees, though we'll flag how such changes affect your project as soon as we're aware of them.

We carry out our work with reasonable skill and care. We can't guarantee outcomes that depend on a third party's decision — a particular install number, a store ranking, or an app review being approved — because those sit outside our control. To the extent the law allows, Kervon's liability for any claim relating to our services is limited to the fees you paid for the specific engagement the claim relates to.

Both sides agree to keep any non-public business or product information shared during a project confidential, and to use it only for that project.

Either side can end an ongoing retainer with 30 days' written notice. A fixed-scope development project can be ended early, subject to payment for the work already completed. Our Refund Policy explains how any refund is handled in either case.

These Terms are governed by the laws of England and Wales, and any dispute relating to them falls under the exclusive jurisdiction of the courts of England and Wales.

We may update these Terms as our services change. Continuing to use our website or services after an update means you accept the revised version.
